Welcome to https://www.o-psych.com, our website and/or the Psych Me mobile app (collectively known as the “Platform”). These Terms of Use together with all other policies (including but not limited to our PDPA Policy and Term for Paid Services) govern your access and use of the Platform.

Before using the Platform, you must read carefully and accept these Terms of Use and all other terms and conditions and policies pertaining to the use of the Platform and/or the Services, and you must consent to the processing of your personal data as described in the Privacy Policy set out at https://www.o-psych.com/privacypolicy/.

If you do not agree to these Terms of Use and the Privacy Policy, do not access and/or use this Platform and/or the Services.

Use of Platform/ Services

The content provided on this Platform is solely for informational and research purposes.

The Platform does not include the provision of medical care or advise, mental health services or any other professional services related thereto. It is not intended to diagnose, treat, or cure any physical illness or psychological disorders. This Platform does not create a doctor/ patient relationship.

We reserve the rights to upgrade, modify, suspend or discontinue the provision of or remove, whether in whole or in part, the Platform or any Services without any prior notice and we shall not be liable if any such upgrade, modification, suspension or removal prevents you from accessing the Platform or any part of the Platform and/or the Services.

Representation and Warranties

By using the Platform and/or the Services or registering an account, you expressly represent and warrant that you are legally entitled to accept and agree to the Terms of Use and that you are at least eighteen (18) years old. If you are below 18 years old, your parent or guardian must consent to the use of the Platform and/or Services. You confirm that all the information which you provide shall be true and accurate. Your use of the Platform and/or Services is for your sole personal use. You undertake not to authorise others to use your identity or account and you may not assign or transfer your account to any other person.

Intellectual Property Rights

No content in the Platform (including but not limited to videos, training materials, products, podcasts, guidebook, graphics, software, services and/or other materials) may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, used for public or commercial purposes unless written permission is expressly granted by O Psych.

All intellectual property rights, whether registered or unregistered, in the Platform, information content on the Platform and all the website/ mobile application design, including, but not limited to, videos, training materials, products, podcasts, guidebook, graphics, software, services and/or other materials and all software compilations, underlying source code and software (collectively referred to as “Intellectual Property”) shall remain O Psych’s property or where applicable, our affiliates or third party intellectual property owners. The entire contents of the Platform also are protected by copyright as a collective work under Malaysia copyright laws. All rights are strictly reserved.

Limitation of Liability

While O Psych tries its best to make this Platform and the information in it available, accurate and secure, we do not guarantee:

(i)

the security, availability, accessibility, timeliness and uninterrupted use of this Platform;

(ii)

the truth and accuracy of content or future changes to it;

(iii)

the actions of other users on this or other Platforms;

(iv)

the accuracy, effectiveness and reliability of results from using this Platform, and that we can or will correct any errors in the software any obligation, liability, right or claim, whether or not O Psych is found negligent.

O Psych will not be liable for any damages you may suffer from using this Platform or from the modification, suspension or discontinuance of the service of this Platform.

This Platform may contain hypertext links to websites created and maintained by other organisations. O Psych is not responsible for the contents of those websites. We shall not be liable for any loss or damage that you may suffer from using these websites or their content.

Any risk of misunderstanding, error, damage, expense or losses resulting from the use of the Platform and/or Services is entirely at your own risk and we shall not be liable therefore.
